By accessing or using the AvAiOs platform and website located at getavaios.com (the "Service"), operated by Dynamark Media Inc. ("we," "us," or "our"), you agree to be bound by these Terms & Conditions. If you do not agree to these terms, do not use the Service.

AvAiOs is an operational intelligence platform designed for AV integration firms. The Service connects to third-party business tools to analyze operational data and deliver actionable insights and notifications.

You must be at least 18 years of age and have the legal capacity to enter into a binding agreement to use the Service. By using the Service, you represent and warrant that you meet these requirements.

To access certain features of the Service, you may be required to create an account. You agree to:

• Maintain the security of your account credentials.
• Notify us immediately of any unauthorized access to your account.
• Accept responsibility for all activity that occurs under your account.

By opting in to receive SMS/MMS messages from AvAiOs, you agree to the following:

• You consent to receive SMS/MMS messages at the phone number you provide for service-related communications, including operational alerts, notifications, and account updates.
• Message frequency varies based on your account activity and preferences.
• Message and data rates may apply.
• You may opt out at any time by replying STOP to any message. For help, reply HELP or contact us at privacy@dynamarkmedia.com.
• Consent to receive SMS/MMS messages is not a condition of purchasing any goods or services.
• Carriers are not liable for delayed or undelivered messages.

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
• Attempt to gain unauthorized access to any part of the Service or its related systems.
• Interfere with or disrupt the integrity or performance of the Service.
• Reverse engineer, decompile, or disassemble any aspect of the Service.
• Use the Service to transmit any malicious code, spam, or harmful content.

All content, features, and functionality of the Service — including text, graphics, logos, software, and design — are the exclusive property of Dynamark Media Inc. and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

The Service may integrate with third-party tools and platforms. Your use of those integrations is subject to the respective third-party terms and privacy policies. We are not responsible for the availability, accuracy, or practices of third-party services.

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

To the maximum extent permitted by law, Dynamark Media Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, arising from your use of or inability to use the Service.

You agree to indemnify, defend, and hold harmless Dynamark Media Inc. and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service or violation of these Terms.

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease.

These Terms shall be governed by and construed in accordance with the laws of the province of Alberta, Canada, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts located in Alberta, Canada.

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated terms on this page with a revised "Last updated" date. Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.
